Please read these Terms & Conditions carefully before using LitFit. By creating an account or using the app, you agree to be bound by these terms.
By downloading, installing, or using LitFit ("the App"), you agree to these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, do not use the App.
These Terms apply to all users of LitFit, operated by LitFit ("we", "us", or "our").
LitFit is a personal fitness tracking application. You may use it solely for your own personal, non-commercial purposes. You agree not to:
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately if you suspect any unauthorized use of your account.
You are responsible for all activity that occurs under your account. LitFit is not liable for any loss or damage arising from unauthorized access to your account.
LitFit lets you add photos, measurements, notes, and other content to track your fitness progress ("Your Content").
We may remove content or suspend accounts that violate these Terms.
LitFit is not a medical application. The information and tracking features provided are for general fitness purposes only and do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new fitness program.
We are not responsible for any injury, health issue, or adverse outcome resulting from use of the App or reliance on any information provided within it.
Your use of LitFit is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described in that policy.
LitFit may offer premium features through paid subscriptions in the future. When subscriptions are available:
LitFit is not responsible for any charges incurred through the App Store beyond what is clearly presented at the time of purchase.
All content in LitFit — including but not limited to the name, logo, design, graphics, text, and code — is owned by LitFit and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes only. Nothing in these Terms grants you any rights to our intellectual property beyond this limited license.
While we take reasonable measures to protect your data, we cannot guarantee uninterrupted availability of the App or permanent retention of your data. We are not liable for any loss of workout data, profile information, progress photos, or other content stored in the App due to technical failures, data corruption, or service interruptions.
We recommend regularly reviewing your data within the App.
We reserve the right to suspend or terminate your access to LitFit at any time, without notice, if we determine that you have violated these Terms or engaged in conduct that could harm other users, third parties, or LitFit.
You may delete your account at any time through the App settings.
To the maximum extent permitted by applicable law, LitFit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of the App.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.
LitFit is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be error-free, secure, or continuously available.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
For significant changes, we will make reasonable efforts to notify you through the App.
